The Supreme Court on Tuesday said that the Income Tax Department can continue tax assessment of Congress President Rahul Gandhi and his mother Sonia Gandhi, but cannot issue any final order.
The decision comes after the Delhi High Court in September, dismissed the petition of both the Congress leaders challenging the reopening of tax assessment for 2011-12. A bench of justices S Ravindra Bhat and AK Chawla said the petitioners could further raise the issue with the tax department.
The hearing of the special leave petition filed against the tax department’s move to reopen tax assessment for 2011-12 against Sonia Gandhi, Rahul Gandhi and Congress leader Oscar Fernandes, will next take place on January 8, 2019.
The income tax probe against the Congress leaders has arisen from the investigation into the private criminal complaint filed by BJP leader Subramanian Swamy before a trial court in connection with the National Herald case, in which the trio is out on bail.’
