Gandhi, who recently resigned as party president, surrendered before Additional Chief Judicial Magistrate Kumar Gunjan, who is the judge for special MPs and MLAs court and was granted bail on a surety amount of Rs. 10,000.
In the run up to the Lok Sabha elections, Gandhi made the comments during a rally at Kolar, Karnataka. He had said, “I have a question. Why do all thieves have Modi in their names whether be it Nirav Modi, Lalit Modi, and Narendra Modi? We don’t know how many more such Modis will come out.”
In retaliation, Sushil Modi had filed a defamation suit against Gandhi for statement. “Rahul defames and hurts the sentiments of everyone who has the Modi surname,” he had said.
The senior Bharatiya Janata Party (BJP) leader had filed the case in the CJM court in Patna under Section 500 of the IPC alleging him of defaming and hurting the sentiments of people with Modi surnames.
After being granted bail, Gandhi took a jibe at the RSS and the Modi government. “Whoever stands against RSS’ and Narendra Modi ji’s ideology is attacked, court cases are slapped. My fight is to save the Constitution, to stand for the poor & the farmers,” he said.

Sushil Modi’s counsel Shambhu Prasad said the court fixed the date of next hearing on August 8 after Gandhi pleaded not guilty.
Additionally, two more cases have been filed against him for the remark. On April 24, BJP leader Manoj Modi filed a case against Gandhi in the Chief Judicial Magistrate’s (CJM) court in Bihar’s Purnea district, while BJP MLA Purnesh Modi from Gujarat filed a suit on May 2.
After appearing, the former Congress president stopped by at a restaurant to have dosa before he left for the Patna airport.
