Rajya Sabha passed the controversial Muslim Women (Protection of rights on Marriage) bill 2019 widely known as the Triple Talaq bill amid walk-out by the JD (U) and AIADMK both allies of BJP.

The Rajya Sabha Chairman Venkaiah Naidu rejected the opposition’s demand to send the bill to a select parliamentary panel for further scrutiny. The bill was passed with a majority of 99 votes in a close contest with 84 votes against the bill.

BJP led NDA finally managed to pass the bill in the present form which criminalizes the practice of instant triple Talaq. Triple Talaq bill, drafted by the ruling BJP seeks to criminalize the practice of instant divorce among certain Muslim communities.


The bill entails a jail term up to three years as punishment to the offenders thus making it a penal offence. Most of the opposition members were against the criminalization of Triple Talaq.

Law minister Ravi Shankar Prasad introduced the bill in the Upper house on Tuesday after the bill was passed by the Lower house on Thursday last week.

Heated debate marred Rajya Sabha on Tuesday with the introduction of Tiple Talaq bill. Parties that opposed the bill include- Congress Party, Trinamool Congress, DMK, CPI(M), BSP, Samajwadi Party, PDP, YSR Congress, TDP, RJD, NCP and Aam Admi Party among others. While AIADMK and JD(U) both allies of BJP walked out.

The bill seeks to replace the ordinance passed by the government in February which lapsed after the dissolution of 16th Lok Sabha as it was pending in the Rajya Sabha.

Earlier during the debate in Lok Sabha, AIMIM Chief Asaduddin Owaisi termed the bill discriminatory. He told the house the bill violates Article 14 and 15 of the constitution.
